Abstract

The Ph.D research is concerned with the topic of globalisation, by analysing the specific case of competition policy within the framework of the global economy. This project will discuss the enactment of competition laws and policies as an example of how market economies require both prior political conditions and state enforcement to function. In the context of a global economy the issue presents a governance dilemma regarding the ability of states to construct patterns of national and international public policy to deal with increasingly international market forces. This research aims to explore the tensions between national jurisdiction and the need for a comprehensive regulation of competition by understanding how states will cope with the transnational problems and tensions related to competition policy instances which arise in the context of different regulatory goals and procedures. Various ideas include harmonisation, reciprocity, cooperation agreements and extraterritorial measures. However, fundamental differences in domestic political structures among societies and their particular state market complexes affect some of the questions above.
