| Public international law attributes the primary responsibility for ensuring that ships comply with applicable rules and standards to the flag state of the ship. Unfortunately, certain states do not meet their obligations in this respect. This situation leads to incidents involving serious damage to the marine environment and unsustainable fishing practices. The research envisages a systematic analysis of the legal questions concerning the consequences of the non-compliance by the flag state of the duty to effectively exercise jurisdiction and control over its ships, especially looking at the possibilities of other states to take action against the flag state. |
